1. Acceptance of Terms
By accessing or using Inqvey, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. We recommend reading these terms carefully before creating an account or using the platform.
These terms constitute a legally binding agreement between you and Inqvey. If you are using the service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
2. Description of Service
Inqvey is an AI-powered market research platform that provides predicted survey responses. Using advanced language models and calibration techniques, Inqvey generates synthetic survey results that approximate how real populations would respond to your research questions.
The service includes survey creation tools, AI-generated predictions, data visualisation, and export capabilities.
3. Account Registration
To use Inqvey, you must create an account through our authentication provider, Clerk. You must:
- Be at least 18 years of age.
- Provide accurate and complete registration information.
- Keep your account credentials secure and not share them with others.
- Notify us immediately if you suspect unauthorised access to your account.
You are responsible for all activity that occurs under your account.
4. Pricing and Payments
Payments are processed securely through Stripe. Prices are displayed on our pricing page and may change with reasonable notice.
Refund Policy
- Completed predictions: No refunds are available for completed predictions, as the data has already been generated and delivered.
- Failed or incomplete predictions: Refunds will be considered on a case-by-case basis for predictions that failed to complete or did not deliver the expected output due to a platform error.
5. Acceptable Use
When using Inqvey, you agree not to:
- Use the service for any illegal or unauthorised purpose.
- Attempt to reverse engineer, decompile, or disassemble any part of the platform.
- Scrape, crawl, or harvest data from the platform using automated tools.
- Access the service through automated means beyond any provided API.
- Interfere with or disrupt the integrity or performance of the service.
- Attempt to gain unauthorised access to other users' accounts or data.
- Use the platform to generate misleading research presented as human-conducted surveys without disclosure.
6. AI-Generated Content Disclaimer
All predictions generated by Inqvey are produced by artificial intelligence models. These predictions are designed to approximate real survey outcomes and should be used as directional guidance, not as definitive market research.
Our accuracy has been benchmarked at approximately plus or minus 2-5 percentage points compared to human survey panels. However, accuracy is not guaranteed for any specific prediction or topic. Results may vary depending on the question type, target demographic, and subject matter.
You are responsible for evaluating the suitability of AI-generated predictions for your specific use case.
7. Intellectual Property
Inqvey owns all rights to the platform, including the software, AI methodology, calibration techniques, branding, and design. These are protected by copyright and other intellectual property laws.
You retain ownership of the survey questions you create and the prediction results generated from your surveys. You are free to use, share, and publish your results as you see fit.
8. Data Ownership
You retain full ownership of your data, including survey questions, configurations, and generated results. Inqvey does not claim ownership over any customer-created content.
Inqvey may use aggregated, anonymized usage data to improve the service. This data does not identify individual users or include specific survey content. For example, we may analyse patterns such as average question count or popular question types to improve the platform.
9. Open Data Pool
Inqvey publishes its own research on general-interest topics through the Open Data Pool. This content is created by Inqvey, is Inqvey's intellectual property, and is made available for public use.
The Open Data Pool never contains customer data. Customer surveys and predictions are always private and are never included in publicly available datasets.
10. Limitation of Liability
To the maximum extent permitted by law, Inqvey's total liability for any claims arising from your use of the service is limited to the total fees you have paid to Inqvey in the 12 months preceding the claim.
Inqvey is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.
11. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Inqvey does not warrant that:
- The service will be uninterrupted, secure, or error-free.
- Predictions will match actual market outcomes or real survey results.
- The service will meet your specific requirements or expectations.
- Any errors in the service will be corrected within a particular timeframe.
12. Indemnification
You agree to indemnify, defend, and hold harmless Inqvey and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the service, your violation of these terms, or your violation of any rights of a third party.
13. Termination
Either party may terminate this agreement at any time. You can close your account through your account settings or by contacting us.
Inqvey reserves the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the service in a way that could harm other users or the platform.
Upon account closure, your data will be deleted within 30 days. Once deleted, data cannot be recovered.
14. Governing Law
These terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
15. Dispute Resolution
In the event of a dispute arising from these terms or your use of the service, the parties agree to the following resolution process:
- Good faith negotiation: The parties will first attempt to resolve the dispute through informal, good-faith negotiation for a period of at least 30 days.
- Mediation: If negotiation is unsuccessful, the parties will attempt mediation administered by an agreed-upon mediator in New South Wales, Australia.
- Court proceedings: If mediation fails, the dispute may be brought before the courts of New South Wales, Australia.
16. General Provisions
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Entire Agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and Inqvey regarding your use of the service. They supersede all prior agreements, communications, and understandings.
Waiver
The failure of Inqvey to enforce any right or provision of these terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Inqvey to be effective.
